ARTICLE V. GOVERNING BODY
Section 1. SUPREME POWER
The General Council shall consist of all Tribal Citizens who are eighteen (18) years or older. The General Council is the supreme power of the Wiyot Tribe and as such, has authority to elect, recall or suspend the members of the Tribal Council, to propose and adopt referenda that repeal, modify or enact tribal laws and ordinances, and to directly exercise such other powers as are expressly reserved by the General Council in this Constitution. Such power shall be exercised by the authority of the General Council at any lawfully held General Council meeting, provided that, a General Council quorum is present, and provided further that, notice of any issue that will be put to vote at a General Council meeting is first provided in accordance with the General Council Meeting Ordinance.
Section 2. RIGHTS OF TRIBAL CITIZENS
Except as otherwise provided by this Constitution, all Tribal Citizens are accorded equal rights, equal protection, and equal opportunities to participate in the economic resources and activities of the Tribe, and no Citizen shall be denied any of the rights or guarantees set forth in the Indian Civil Rights Act of April 1, 1968 (82 Stat. 77) including but not limited to freedom of religion and conscience, freedom of speech, the right to orderly association or assembly, the right to petition for action or the redress of grievances, and due process of law.
Section 3. TRIBAL COUNCIL
a) For the orderly transaction of business, there shall be elected from the General Council a Tribal Council known as the Wiyot Tribe Tribal Council. It shall be the duty of the Tribal Council to govern all people, resources, land, and waters reserved to the Indians of the Wiyot Tribe in accordance with this Constitution, such laws as may hereinafter be adopted by the Tribe and such limitations as may lawfully be imposed by the Tribe and such limitations as may lawfully be imposed by the laws of the United States.
b) The Tribal Council shall consist of four (4) officers and three (3) Council members: A Chairperson, Vice-Chairperson, Secretary, Treasurer, and Three (3) Council Members.
Section 4. QUALIFICATIONS FOR TRIBAL COUNCIL
Any candidate running for a position on the Tribal Council must meet the following qualifications:
a) Citizenship in the Tribe.
b) 18 years of age or older.
c) Test alcohol and drug-free.
d) Must have completed probation for any convictions of a felony or a crime of moral turpitude at least two (2) years prior to their election.
e) Cannot have been recalled from any elected tribal office or have had their citizenship suspended within three (3) years of their election.
