ARTICLE XI. REFERENDUMS AND REPEALS

Upon receipt by the Tribal Secretary of a petition signed by at least twenty (20) voting General Council Citizens demanding a referendum that calls for repealing, modifying or adopting any Tribal Ordinance, the General Council shall hold a Special Meeting within thirty-five (35) days after receipt of the petition by the Tribal Council Secretary. At the Special Meeting of the General Council held pursuant to this section, the referendum may be adopted by a majority vote of the General Council present at the meeting, provided that a quorum of the General Council is present and cast their ballots. If a petition is filed pursuant to this section with the Tribal Council Secretary within sixty (60) days of a scheduled General Council Meeting, the referendum will be conducted at such General Council Meeting.

a) No referendum or repeal conducted pursuant to these provisions shall serve to abrogate, modify or amend any properly executed contract or agreement approved by the Tribal Council or entered into with third parties.

b) No referendum conducted pursuant to these provisions shall serve to abrogate, modify or amend this Constitution. Any constitutional change must be conducted pursuant to Article XIV of this Constitution.
