Upon a finding that an individual has failed to rectify a determined violation within 30 days of a second violation, or as more particularly prescribed by the Council, the Wiyot Tribal Business Council shall, at its option, proceed as follows:

A. Initiate direct enforcement action by the Wiyot Tribal Business Council when appropriate as follows:

1. The violator’s water will be shut off; or

2. If the violator is a member of the Tribe, the Wiyot Tribal Business Council may revoke privileges provided by the Tribe (i.e., rescind lot assignment(s) for residents of Wiyot Tribe Reservation); or

B. Initiate direct enforcement action by appropriate local enforcement agency upon recommendation by the Wiyot Tribal Business Council; or

C. Through the Tribe’s attorney, petition a court of competent jurisdiction for the issuance of an injunction requiring such person to comply therewith. In any such suit the court shall have jurisdiction to grant a prohibitory or mandatory injunction, either preliminary or permanent, and to levy such fines in accordance with WTC 10.05.080, as the facts may warrant.
