In construing the provision of this chapter, the following words or phrases shall have the meaning designated unless a different meaning is expressly provided, or the context clearly indicates otherwise:

“Adjacent lands” means all lands within 100 feet of the Wiyot Tribe’s wetland zone boundary.

“Best management practice (BMP)” means design, construction, and maintenance practices and criteria for storm water facilities that minimize the impact of storm water runoff rates and volumes, prevent erosion, and capture pollutants.

“Material” means matter or substance that can pose a threat to the health of the environment. Such material can include, but is not limited to, brush, garbage, hazardous and nonhazardous waste, etc.

“Person” means any individual, corporation, firm, partnership, joint venture, association, social club, estate, trust, the United States, tribe, state, county, city, district or other political subdivision of any state or any other group or combination acting as a unit.

“Wetland” means areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions.

“Wetland zone” means an area delineated by an existing fence line that provides for undisturbed habitat including, and adjacent to, the Wiyot Tribe’s wetland (Figure 1). [Ord. 11-02 Art. III, approved 11/1/02.]
