A. No building shall be erected, altered, placed or permitted to remain on any residential assignment other than one single-family dwelling not to exceed two and one-half stories in height and a private garage for not more than two cars. An animal shelter, smoke house and tool or storage building may be constructed provided the exterior finish is compatible with that of the residence.

B. A copy of building plans must be submitted for Tribal Council approval before any construction is started. No building or mobile home shall be erected, placed or altered on any lot until the construction plans and specifications and a plan showing the location of the structure have been approved by the Council; provided that, in the event the Council fails to act within 45 days from the date the plans are submitted, such plans shall be deemed approved. In the event the Council disapproves plans, the applicant shall be provided written notice of the reasons for the disapproval together with notice that they may appear before the Tribal Council to seek reconsideration. Each person appearing before the Council shall be given an opportunity to be heard including the right to be represented by counsel and the right to present witnesses on his/her behalf.

C. No dwelling shall be permitted on any lot at a cost of less than $45,000.00, based upon cost levels prevailing on the date the ordinance codified in this chapter is first adopted; provided that, this section shall not prohibit construction of federally assisted housing such as HIP or HUD housing, if the total per unit grant allocation is less than the minimum stated above. It is the intention and purpose of this section to assure that housing needs of the Tribe are met and that, to the maximum extent possible, all dwellings shall be of a quality of workmanship and materials substantially the same or better than that which can be produced on the date the ordinance codified in this chapter is first adopted at the minimum cost stated herein for the minimum permitted dwelling size. The ground floor area of the main structure, exclusive of garages, shall be not less than 800 square feet. All buildings shall meet building standards set forth in 25 C.F.R. §256.2, relating to BIA HIP housing. Nothing herein is intended to prevent construction of a dwelling by the property owner, provided the desired quality of workmanship is maintained.

D. Mobile homes will be permitted in the following design controls:

1. Minimum size: Doublewide of not less than 800 square feet floor area;

2. Must have nonmetal roof (can be composition shingles, shakes, or tar and gravel);

3. Homes must be skirted in wood;

4. Outside finish to be of natural wood siding stained or painted in earth tones;

5. Must have outside storage building to take care of items not able to keep inside of the home.

E. No structure of a temporary character, trailer, basement, tent, shack, garage, barn or other outbuilding shall be used on any lot at any time as a residence either temporarily or permanently, except that a travel trailer, motor home or self contained camper with proper sanitation facilities may be used as a temporary housing during short visits not to exceed one month or during the construction of a home but not to exceed 18 months.
