A. All applicants must make application to the Tribal Council for an assignment of Tribal land. Applications for assignments shall be filed with the Tribal Council and shall be in writing, setting forth the name of the person applying for the land, sufficient information to show that the applicant meets all of the requirements set forth in WTC 15.05.070, and as accurate a description of the land desired as circumstances will permit.

B. The Tribal Council shall review all applications in the order in which they are received to determine whether they are properly prepared and to check whether applicants meet all eligibility requirements of this assignment chapter.

C. The Tribal Council within 60 days from its receipt thereof, properly prepared, shall by formal resolution either approve or disapprove the application. Within 30 days after rendering a decision the Council shall proceed as follows: When an application is approved by the Council, the applicant shall be so notified and, upon completion of such forms and agreements as may be required by the Council, an assignment instrument shall be issued to the assignee by the Council. Forms which must be completed by the applicant shall include, but not be limited to, a notarized statement designating primary and secondary beneficiaries to succeed to an assignment in the event of the death of an assignee, and as appropriate, a nomination of guardian of the Tribal estate for minor children. When an application is disapproved the Council shall return all rejected applications to the applicant by letter, advising as to the reason or reasons for such rejection and advising the applicant of the right to appear before the Council to request that the Council reconsider its decision. Each person appearing before the Tribal Council shall be given an opportunity to be heard including the right to be represented by counsel and the right to present witnesses on his/her behalf.

D. The Tribal Council shall maintain a permanent record on each individual assignment including actions taken in regard to and dispositions of applications therefor.

E. All land assignments shall be surveyed by an individual designated by the Tribal Council. No assignment shall be made in unsurveyed areas or on lots considered to be more valuable to the Tribe as a Tribal holding for conservation, commercial, or other community Tribal purposes.
