A. Except as required under regulations promulgated under subsection (E) of this section, in granting assignments, preference shall be given to otherwise eligible applicants as follows:

1. Elderly applicants, 55 years or older;

2. Handicapped/disabled applicants;

3. Heads of families with dependents;

4. Married applicants;

5. Single applicants.

B. Notwithstanding subsection (A) of this section, and subject to subsection (E) of this section, an applicant without land shall be given preference over applicants owning lands.

C. An otherwise eligible applicant owning personal property as defined in WTC 15.05.040 on Tribal land shall be given preference in relation to assignment of said land.

D. This section shall not apply to reassignment of land upon the death of an assignee in accordance with WTC 15.05.100.

E. Prior to the issuance of any assignment on lands acquired in conjunction with settlement of the lawsuit entitled Table Bluff Band of Indians, et al., v. Lujan, et al., No. C-75-2525, the Tribal Council shall promulgate regulations setting forth preferences to be applied in the assignment of said lands which directly reflect the requirements and purposes of the stipulated judgment in that case. Said regulations shall, among other things, establish some preference for eligible Tribal members authorizing and committing to demolition of dwellings existing on lands referred to in the stipulated judgment as the “old site.” [Ord. 5-91 Art.
