A. Imposition of Sanctions of Violation of Code of Conduct. Sanctions must be appropriate for the severity of the code of conduct violation and the motive of the Respondent in committing the violation. A less severe violation deserves a lesser sanction. A violation based on carelessness deserves a lesser sanction than an intentional violation. Repeat violations also deserve a greater sanction.

B. Types of Sanctions. The following are the types of sanctions that may be considered. The sanctions are listed in the order of their severity starting with the lesser sanctions:

1. Reprimand or censure;

2. Repayment or return of any financial gains or gratuities improperly received or obtained;

3. Monetary fine;

4. Temporarily or permanently taking away privileges of Tribal Council membership;

5. Removal as an officer of the Tribal Council;

6. Suspension from the Tribal Council;

7. Removal from the Tribal Council;

8. Prohibition against serving on the Tribal Council for a period of time or permanently.

C. Imposition of Sanctions. The Tribal Council (or general membership) of the Tribe may impose any of the above sanctions as they determine appropriate after giving the individual accused of violating the code of conduct an opportunity to respond to and be heard in regards to any allegations against him or her.
