Any person or entity adversely affected by a decision of the Commission, including but not limited to the gaming operation or any employee thereof, may petition the Tribal Council for review of such decision within 30 days after receiving notice of the decision. Said decision shall only be reversed by a majority vote of the Tribal Council at a duly held meeting at which such matter has been placed on the agenda at least 15 days prior to such meeting. The Tribal Council is authorized to reverse a decision made by the Commission only where the Tribal Council finds, by a majority vote of those present at the meeting, that:

A. The Commission’s decision was unreasonable, arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with applicable Tribal, federal or state laws;

B. The Commission exceeded its jurisdiction, authority, or limitations, under applicable Tribal laws;

C. The Commission’s decision is unsupported by substantial evidence or unwarranted by the facts. [Ord. 09-03 Art. IX § 2, approved 11/8/03.]
