Any exclusion orders issued pursuant to this chapter and as authorized by the Tribal Council shall conform to the requirements in this section.

A. Duration. An exclusion order shall clearly indicate the duration of time such exclusion will be in effect, including whether the exclusion is temporary or permanent. For any exclusion order issued on a temporary basis, such order shall state the condition or restrict the person’s future re-entry onto Tribal lands to strict compliance with the terms of such order and all Tribal laws and regulations.

B. Physical Scope. An exclusion order shall clearly indicate whether the person subject to the order is excluded from all Tribal lands or from a portion of Tribal lands. If the exclusion applies only to a specific portion of, but not all Tribal lands, the order shall clearly specify the portion of Tribal lands to which the order applies.

C. Modification. The Tribal Council is authorized, upon a finding of good cause and reasonable written notice, to modify any exclusion order.

D. Violation of Exclusion Order. It is unlawful and constitutes a violation of this chapter and may constitute a misdemeanor under state law for any person to enter and occupy Tribal lands or any real property or structures of any kind contained therein without the consent of the Tribe if such person is subject to an exclusion order pursuant to this chapter.

E. Mandatory Language in Order. All exclusion orders issued under this chapter shall state, in part:

You are hereby excluded from entering and occupying all or that portion of Tribal lands as may be indicated in this order, and any real property or structures of any kind contained herein, without the consent of the Tribe.
