A. When a key employee or primary management official begins work at a gaming operation authorized by this chapter, the Commission shall forward to the NIGC a completed application for employment and conduct the background investigation and make the determination referred to in this chapter. The Commission shall prepare and forward to the NIGC, within 60 days after a key employee or primary management official begins work or within 60 days of the approval of this chapter by the Chairman of the NIGC, an investigative report on each background investigation and a copy of the eligibility determination made under this chapter. The background investigation report shall include all of the following:

1. Steps taken in conducting a background investigation;

2. Results obtained;

3. Conclusions reached; and

4. The basis for those conclusions.

B. With respect to key employees and primary management officials, if a license is not issued to an applicant, the Commission shall notify the NIGC and may forward copies of its eligibility determination and investigative report (if any) to the NIGC for inclusion in the Indian Gaming Individuals Records System.

C. With respect to key employees and primary management officials, the Commission shall retain applications for employment and reports (if any) of background investigations for inspection by the Chairman of the NIGC or his or her designee for no less than three years from the date of termination of employment.
