Unrestrained livestock and all other domestic animals such as horses, cattle and dogs have created a health and safety hazard by straying onto other people’s property. In some instances said animals have caused or threatened to cause actual physical damage to persons and property, including the destruction of gardens and spilling of garbage containers and spreading garbage in the vicinity.

A. Unattended livestock or other domestic animals must be restrained (to keep under control) or confined in appropriate fenced areas at all times.

B. The owners of any livestock or other domestic animals roaming unattended shall be given a written notice by the Chairperson of the Tribal Council or his authorized representative. Said notice shall inform the owner of the identity of the animal as well as the date and time the animal was located roaming loose and unattended.

The notice shall further specify that the owner must confine the animal in accordance with this chapter within 24 hours of receipt of the notice or a violation citation shall be issued to the owner of the animal.

C. Any animal that is the subject of one violation citation shall thereafter be subject to seizure, and confiscated by the Humboldt County Animal Control.

D. Any person receiving a citation notice shall have the right to contest the issuance of the citation by appealing to the Tribal Council within 24 hours of the violation notice between the hours of 9:00 a.m. and 5:00 p.m. [Ord. 01-87, approved 5/13/87.]
