In construing the provision of this chapter, the following words or phrases shall have the meaning designated unless a different meaning is expressly provided, or the context clearly indicates otherwise:

“Burn barrel” means a metal container used for burning nonhazardous materials.

“Notice” means a written notification from the Tribal Business Council or Council-appointed designee, mailed to Tribal members mailing addresses.

“Open burns” means on-container open burn for burning nonhazardous materials, in a space designated by the Environmental Department, with a special permit.

“Permit” means authorizing document for use of a burn barrel or open burn.

“Regulate” means establishment of rules to govern burning activities within the Reservation boundaries.

“Reservation” means all lands within the exterior boundaries of the Wiyot Tribe Reservation, and such other lands as may hereafter be acquired by the Wiyot Tribe, whether within or without such boundaries under any grant, transfer, purchase, gift, adjudication, executive order, Act of Congress or other acquisition.

“Toxic/hazardous” means any product known or suspected to have serious effects to human health or the environment (see WTC 8.05.060(C)).

“Tribal Council” means the Tribal Council, as established in Article VI of the Constitution of the Wiyot Tribe. [Amended 5/13/02; Ord. 06-01 Art. III, approved 4/7/01.]
