Assignments which are granted pursuant to this chapter are granted for the specific purpose of providing a home site for the assignee and for purposes of being put to other similar personal beneficial uses. Assignments so granted are subject to cancellation for violation of any of the following provisions.

A. The assignee shall comply with all terms of this chapter as well as with the terms of any grant or occupancy agreement which may be required to be executed in the case of BIA Housing Improvement Program, HUD housing or other similar programs.

B. The assignment and improvements thereon shall be maintained in a neat manner and subject to any sanitation regulations existing at the time the assignment is made and to any sanitation regulations which may be enacted subsequently by the Council.

C. Assignments shall not be used for unlawful purposes.

D. Assignments shall not be transferred, assigned or exchanged without the approval of the Tribal Council and, except as otherwise provided in this chapter, may not be rented or leased.

E. Improvements which are part of the real property shall not be removed without authority from the Tribal Council.

F. An assignment shall not be used in such a manner as to create a public nuisance, allow conditions to exist which would endanger life or the property of any assignee.

G. Absent prior written consent of the Tribal Council for good cause shown, and except as set forth in this chapter, failure of the assignee to establish a residence within 18 months from the date the assignment is first assigned or, thereafter, to use the assignment for a period of 18 consecutive months shall be sufficient cause for cancellation; provided, that an assignee, upon written request to the Tribal Council made before expiration of the 18-month period to first establish a residence, shall be entitled to one automatic extension of six months.
