2.20.010 Neglect of duty – Gross misconduct.
Any Tribal (business) Council member, appointed member of any committee, or a special representative of such shall not be involved in:
A. Failure to carry out the assignments as set forth in the bylaws;
B. Charging or collecting illegal fees per diem and mileage or other subsistence from the Tribe or Tribal programs for services not actually performed;
C. Immoral conduct including verbal threats or abuse and violence of any nature;
D. Intoxication while on duty as an official representative of the Tribe during a meeting, conference, convention or any assignment, on or off the Wiyot Tribe lands;
E. Using his/her position to force (coerce) or give the appearance of forcing any member of the Tribe to provide a financial benefit or personal benefit to himself/herself or any other person;
F. Making fraudulent or false statements while on duty;
G. Mutilating or destroying Tribal property or records or wilfully withholding some;
H. Any conduct which adversely reflects on the purpose and good name of the Wiyot Tribe;
I. Signing documents without general Tribal Council approval;
J. Asking or requesting any agency or organizational representative to attend a general Tribal Council meeting without approval of the general Tribal Council;
K. Using his/her position for self gain;
L. Conflict of Interest. A member who might benefit from his/her official actions on the Tribal Council, committee or as a special representative, such as making policies to benefit him/her by using influence. [Ord. 02-82, approved 4/13/82.]
