A. The benefits shall be available to Tribal members, or, if applicable, specific groups of nonmembers. Approved programs may limit benefits to an identified group of Tribal members or nonmembers.

B. The benefits shall not be given as compensation for services.

C. The benefits shall not be lavish or extravagant under the facts and circumstances.

D. An approved program shall not discriminate in favor of distributing benefits to members of the Tribal Council or any other governing body.

E. The benefits shall be distributed according to an identified need, whether individual or collective.

F. The benefits and approved program must meet the General Test.

G. An approved program may be enacted by Council or by a designee of Council. [Ord. 16-20 § 5, approved 6/8/20.]
