A. Forfeiture. Notwithstanding anything herein to the contrary, benefits may be revoked or forfeited for any beneficiary who is found to have misapplied funds from an approved program or to have made any misrepresentations during the application process. When applicable, a benefit must be used for the purpose stated in the approved program. Assistance may also be forfeited should said benefits be treated as a resource to the detriment of the Tribe or the beneficiary. The Tribe shall have a right of recovery with regard to any excess of improper payments hereunder.

B. Due Process. Each program shall offer procedures that afford a beneficiary an opportunity to address forfeiture issues or concerns with Council, the program director, or other designee.

C. Anti-Alienation. The right of a Tribe citizen to apply for or receive General Welfare benefits (including payments and services) is not subject to anticipation, alienation, sale, transfer, assignment, pledge, encumbrance, levy, attachment, or garnishment by creditors.
