In construing the provisions of this chapter, the following words or phrases shall have the meaning designated unless a different meaning is expressly provided, or the context clearly indicates otherwise:

“Building” means a structure erected to local building codes that contains a roof. Examples can include, but are not limited to, garages, carports, sheds, and maintenance facilities.

“Enforcement officer” means any person designated by the Wiyot Tribal Business Council to investigate and/or enforce the provisions set forth in this chapter.

“Material” means matter or substance that can pose a threat to the health of the environment. Such material can include, but is not limited to, brush, garbage, hazardous and nonhazardous waste, etc.

“Nonoperational vehicle” means a vehicle that is incapable of starting and moving under its own power.

“Person” means any individual, corporation, firm, partnership, joint venture, association, social club, estate, trust, the United States, tribe, state, county, city, district or other political subdivision of any state or any other group or combination acting as a unit.

“Pollutant” means any substance that will alter land, air, water or any other environmental media both within and beyond the exterior boundaries of the Wiyot Tribe Reservation.

“Reservation” means all land, air, and water located within the exterior boundaries of the Wiyot Tribe Reservation.

“Roadway” means a way or location that is used for purposes of vehicular travel.

“Routine vehicle maintenance” means maintenance or scheduled service performed on a vehicle that does not involve any form of vehicle dismantling. Examples can include, but are not limited to, repairs, part(s) replacement, and lube, oil, filter, and tire rotations.

“Undesignated property” means property located within the exterior boundaries of Wiyot Tribe Reservation that is not affiliated with an assigned lot/residence.

“Vehicle dismantling” means the dismantling of vehicles for spare parts, sale, recycling, disposal, vandalism, and/or any other activities that are not defined as routine vehicle maintenance that pose a health and environmental risk due to leakage of hazardous material.

“Wiyot Tribal Business Council” or “Council” means the governing body of Wiyot Tribe. [Ord. 12-01 Art. III, approved 12/1/01.]
