A. A Tribal Council member or other Tribal official is deemed to have a conflict of interest when, as a result of the action of the Tribal Council on any economic enterprise, program, project, contract or other matter under consideration by the Tribe, the Tribal Council member or other Tribal official, or any member of his/her immediate family:

1. Has any financial interest in, or receives or has expectations of receiving compensation from such economic enterprise, program, project, contract or other matter under consideration by the Tribe that is different or greater than that of any other member of the Tribe; or

2. Will be affected monetarily (by either a gain or a loss) beyond that of other Tribal members by the contemplated actions.

B. For purposes of this chapter, a member of an immediate family is defined as any of the following who live in the same household as the Tribal Council member or other Tribal official.

1. A spouse (or any individual who has lived with the elected Tribal official in a marriage-like relationship for at least one year);

2. A parent or grandparent;

3. A sibling; and

4. A child or grandchild.

C. Excluded from this provision are salaries, honorariums, reimbursements, expenses or other items of value normally provided to a Tribal Council member or other Tribal official as compensation for performing his/her duties. [Adopted 10/11 § 2(B).]
