A. Violation and Penalties. No person shall be in violation of any terms of this chapter. Any person violating any of the provisions of this chapter shall pay a civil fine in an amount not to exceed $1,000.00 for each day in which the violation occurs. The civil fine required by this section shall be imposed by any court of competent jurisdiction in accordance with WTC 14.05.060. In addition to any other penalty authorized by this section, any person, partnership, or corporation convicted of violating any of the provisions of this chapter shall be liable for all costs associated with the clean up, abatement or restoration of Wiyot Tribe’s wetland to the existing condition immediately prior to development.

B. Immediate Notification to Council. Any person that causes any disturbance, discharges any pollutant, or is in any other violation of this chapter that would impact the Wiyot Tribe wetland shall immediately provide the location of the disturbance, discharge, or ordinance violation and any other information as may be required by the Council.

C. If the Wiyot Tribe files suit to collect their reasonable costs and expenses as provided in subsections (A) and (B) of this section, the court may award a reasonable amount as attorney’s fees to the prevailing party. [Ord. 11-02 Art. V, approved 11/1/02.]
